General terms and conditions of sale

Article 1: Reservation

The reservation will only be confirmed once the hotelier has given approval, depending on the availability of the establishment and the payment conditions defined in Article 2 of the general terms and conditions of sale.

Article 2: Payment

A valid credit card in the client’s name will be required as a guarantee upon arrival.

Otherwise, the Hotel reserves the right to refuse access to the room.

The management reserves the right to charge the credit card (provided as a guarantee upon arrival) for amounts owed by the client and not settled by the time of departure: this may include payment for extras, tourist taxes, or damages caused by the client in the rooms.

Once the payment is done, the client’s information will be automatically erased from our hotel software in accordance with GDPR standards.

Flexible reservation:

The hotel will pre-authorize the amount of the first night on the credit card before the arrival date. The full stay must be paid upon departure.

Non-cancellable and non-modifiable reservation:

Hôtel Montaigne will debit the client’s credit card provided during the reservation for the total amount of the stay, which must be paid at the time of the reservation for confirmation. Otherwise, it will be canceled within 24 hours. The stay dates are final.

Article 3: Tourist tax

The tourist tax is never included in the reservation price. It is applicable in the municipality and payable on-site at the Hôtel Montaigne. Applicable rate for 2023: €3.75 per person per night. Applicable rate from January 1, 2024: € 10.73 per person per night.

Article 4: Cancellation / modification of reservation and commitment

Flexible reservation:

In case of modification or cancellation of a flexible reservation, the client is required to notify 48 hours in advance before the arrival date. In case of late cancellation or no show, the first night will be due.

Delays in arrival or early departures cannot under any circumstances lead to a refund.

In case of cancellation or modification up to 6:00 PM, 2 days (48 hours) before the arrival date, the hotel does not charge fees (request needs to be sent by mail).

Non-cancellable and non-modifiable reservation:

The complete amount of the stay is paid in full at the time of reservation. Non-modifiable, non-cancellable, and non-exchangeable.

The hotelier has the option to re-rent a room without delay under the following conditions:

  • Cancellation by the client.
  • Modification of the reservation by the client.
  • Non-appearance of the client.
  • Error by the client when making a reservation, regarding dates, quantity of rooms, or room type.

Article 5: Access to rooms, departure, and arrival

Anyone wishing to stay at the hotel must disclose their identity and present their ID and that of the accompanying persons.

Upon arrival, unless agreed upon by the hotelier, the client cannot demand to occupy the room before 3:00 PM. A luggage service allows guests to leave their bags at the hotel reception.

The credit card in the client’s name, which served as a guarantee or payment, will be requested by the establishment upon arrival. If the client does not have the card used for payment of the non-cancellable and non-modifiable reservation, Hôtel Montaigne will ask for a credit card in their name that will be immediately debited for the total amount of the stay, and the card that was initially charged at the time of booking will be credited.

Check-out must be completed by noon. At the time of departure, the client must return the room key card.

The client is explicitly prohibited from taking any item that belongs to the hotel. In the event of an inadvertent possession, the client must promptly notify the hotelier and return the item; otherwise, he will be charged for it.

Article 6: Baby cots and children’s extra beds

A child under 3 years stays for free, and a crib will be provided in the Classical Montaigne, Deluxe, Deluxe Montaigne, Junior Suites, Terrace Suite, and Montaigne Suite rooms.

From 3 to 12 years, the extra bed is charged at €80 per night per person and may be installed in Classical Montaigne, Deluxe, Deluxe Montaigne, Junior Suites, and Montaigne Suite rooms.

The maximum number of cribs and extra beds per room is 1. Supplements are not included in the total amount of the reservation and must be paid at the time of departure.

Article 7: Extra adult bed

Only Classical Montaigne, Deluxe, Deluxe Montaigne, Junior Suites, and Montaigne Suite rooms can accommodate an extra bed, which will be charged at €80.

Article 8: Pets

Pets weighing less than 5 kg are allowed in the hotel. An additional fee of €25 per night will be applied.

Article 9: Group

A reservation is considered a group reservation starting from 5 reserved rooms. A deposit of 50% of the total reservation amount will be charged at the time of reservation to confirm the group reservation, and specific cancellation conditions will apply.

Article 10: Late departure

Late departures will be granted by Hôtel Montaigne upon request and subject to availability.

Departure between 12 PM and 3 PM: a surcharge of 50% of the room price will be charged.

Departure after 3 PM: payment of 100% of the room price will be charged.

Article 11: Damage

The rooms made available to our clients are checked, functional, and in good condition. Clients are asked to report any deficiencies to the hotel reception immediately.

In case of a problem, the client must assume civil liability. In case of damage, the hotel reserves the right to charge the client the cost of repair or replacement. The same applies to any offense discovered after the client’s departure; the amount of compensation will be debited from the client’s card.

In case of intentional or unintentional damage to hotel equipment, objects, or furniture, the hotel may demand full reimbursement with a penalty and damages ranging from €2000 to €5000.

In case of flooding or water damage, intentional or unintentional, the full reimbursement of the damage caused will be required. If damage occurs in adjacent rooms, the responsible party will be required to reimburse the affected clients for their reserved nights.

The hotel may require a cleaning fee if the room is left in an unacceptable state. In case of damage to the carpet, bedding, or bed base, the hotel will require reimbursement for damage with a minimum fee of €3000 for restoration and rendering the rooms unavailable for rental.

In general, the client must settle damages directly at the hotel. They can use their insurance (if they want reimbursement) for all intentional or unintentional damages caused during their stay. 

All our rooms are non-smoking. The hotel reserves the right to claim the amount of one night for additional cleaning fees from the client who smokes in their room. If the client wishes to continue smoking inside or outside the designated areas, they will be asked to leave the hotel.

In case of non-compliance with the hotel’s internal regulations, the client will be asked to leave the hotel without being able to demand any refund. The hotel reserves the right to deduct the amount of undeclared consumption at the departure, as well as damages in the room. This amount will be deducted from the credit card provided at the reservation. The hotel will have no obligation to notify the client but may provide an invoice upon request.

Article 12: Complaint

Any complaint about the quality of services provided must be presented to the hotelier immediately.

Article 13: Safe

Identity papers and valuable items (watch, jewelry, means of payment, etc.) must be placed in the designated mini-safe. In case of disappearance, Hôtel Montaigne cannot be held responsible.

Article 14: Forgotten Items

Items left or abandoned will be kept for one year. If the client requests the return of their belongings by parcel or mail, it must be done with tracking and insurance for valuables. The shipment will be made after the client pays the shipping fees.

Article 15: Consumer Mediation

The client is informed by the hotel of the possibility to resort, in case of dispute regarding these General Conditions, to a conventional mediation procedure or any other alternative dispute resolution method, in accordance with Title I of Book VI of the Consumer Code.

Consumer mediator:

After contacting the complaint service at the reception of Hôtel Montaigne and failing to receive a satisfactory response within 1 month, the client can contact the Tourism and Travel Mediator, whose contact details and filing methods are available on their website: www.mtv.travel.

Article 16: Acceptance of the Regulations and General Terms and Conditions of Sale

The hotel’s internal regulations apply to all reservations. Any stay implies acceptance of the specific conditions and internal regulations of the Hotel. Non-compliance with the above provisions leads to immediate termination of the contract.
